Online Application Terms of Use:

Application-based or web based services (“Online Services”) are provided by the Company ("AA"). These Online Services are provided as a courtesy to and may only be used by eligible AA members. Please read these terms and conditions carefully before using these Online Services.

Acceptance:

This mobile service is made available to users on the basis of these terms and conditions. By downloading, accessing, browsing, installing or using this Online Service, you acknowledge that you have read and understand these terms and conditions, and that you agree to be bound by these terms and conditions. AA reserves the right, in its discretion, to update or revise these terms and conditions at any time, with or without notice by posting such updated or revised terms and conditions on www.asia-assistance.com or by updating the Online Service to incorporate the new terms of use. You are required to review information posted online regularly to obtain timely notice of such changes. Your continued use of the Online Service after changes are posted or implemented constitutes your acceptance of the amended terms of use.

Access:

It is the your responsibility to ensure your mobile device meets all necessary technical specifications to enable you to access and use the Online Services and its applications. Use of the Online Service does not include the provision of a mobile device or other necessary equipment to access it. AA shall not have any responsibility or liability for any telephone or other costs you may incur.

Restrictions:

You shall not in any way use the Online Service or submit to us or to the Online Service or to any user of the Online Service anything which in any respect:-
(a) is in breach of any law, statute, regulation or byelaw of any applicable jurisdiction;
(b) is fraudulent, criminal or unlawful;
(c) may be obscene, indecent, pornographic, vulgar, racist, sexist, discriminatory, offensive, derogatory, harmful, harassing, threatening, embarrassing, malicious, abusive, hateful, menacing, defamatory, untrue or political;
(d) impersonates any other person or body or misrepresents a relationship with any person or body;
(e) may infringe or breach the copyright or any intellectual property rights or privacy or other rights of us or any third party;
(f) is contrary to any specific rule or requirement that we stipulate on the Online Service in relation to a particular part of the Online Service or the Online Service generally; or
(g) involves your use, delivery or transmission of any viruses, unsolicited emails, trojan horses or computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.
You agree not to reproduce, duplicate, copy or re-sell the Online Service or any part of the Online Service save as may be permitted by these terms of use.

Privacy Policy:

From time to time, you may be providing AA with personal information including but not limited to name, contact number, mobile number and vehicle details. Such personal information will be used by AA in accordance with its Privacy Policy which can be found at http://asia-assistance.com/privacy-policy. To enable AA to provide relevant information to you through the Online Services, you agree to provide true, accurate, current and complete information about yourself.

Disclaimer and limitation of liability:

There is no guarantee or warranty, express or implied of the completeness or accuracy of the data you access, including without limitation, implied warranties of satisfactory quality, fitness for a particular purpose, and that access will be continuous, uninterrupted, timely, secure of error free, defects will be corrected, or that the Online Services or the server that makes it available are free of viruses. You acknowledge that the Online Services are provided “as is” and “as available” for your use. Under no circumstances will AA be liable for any indirect or consequential losses, damages, costs or expenses; loss of use of money; loss of anticipated savings; loss of revenue; loss of goodwill; loss of reputation; loss of, damage to or corruption of, data; whether or not such losses were reasonably foreseeable or we had been advised of the possibility of you incurring such losses in relation to any material on the Online Service or in relation to your use or inability to use or delay in use of the Online Service or any material in it or accessible from it or from any action or decision taken as a result of using the Online Service or any such material, in relation to any of the foregoing. You agree that AA shall not be responsible for unauthorized access to or alteration of your data, or any transactions entered into through the Online Services. Commentary and other materials available on the Online Service are not intended to amount to advice on which reliance should be placed. AA disclaims all liabilities and responsibilities arising from any reliance placed on such materials by any user of the Online Service, or by anyone who may be informed of any of its contents.

Modifications and charges :

AA reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, or impose or change any fees or charges for use of the Online Services, with or without notice, or in accordance with the terms of the separate membership agreement with AA that makes you an eligible user of the Online Services. You agree that AA will not be liable to you or any third party for any unavailability, modification, suspension or withdrawal of the Online Services, or any features, parts or content of any Online Services. If the need arises, AA may suspend access to the Online Service, or close it indefinitely. The mobile services provided by AA will generate mobile data usage. The amount of data usage will vary greatly depending on the frequency and duration of use. AA highly recommends that you subscribe to a “data plan” through your mobile carrier if you elect to utilize the Online Services. Substantial data usage fees may be charged in the absence of a “data plan” or in the event that you exceed your “data plan’s” monthly allotment. It is your responsibility to be aware of the details of your account with your mobile carrier, including what will result in a fee being charged. The terminology used above may vary from carrier to carrier. “International roaming” may increase these fees. If you have any question whether the usage of any Online Services will result in a charge or increase in/on your phone bill, please contact your mobile carrier. In no event shall AA be responsible for any charges, penalties, taxes, overages, or any other fee imposed by your Online Services as a result of your use of the Online Services.

Third party information and links:

Through the Online Services, you may be able to access links to third party web sites (“Linked Sites”) or information obtained from third parties (“Third Party Information”). The Linked Sites and Third Party Information are not under AA’s control and AA shall not be responsible for the contents of any Linked Site or Third Partly information, including without limitation the accuracy, copyright compliance, legality, decency, links or any other aspect of the Linked Sites. AA shall not be responsible for any form of transmission received from any Linked Sites, Third Party Information transmission received from any Linked Sites, Third Party Information or for the ability to access such Linked Sites. AA provides such links and information to you only as a convenience, and the inclusion of any link or Third Party Information does not imply endorsement by AA of such Linked Site or Third Party Information. You are responsible for viewing and abiding by the privacy statements and terms of use posted at the Linked Sites. You agree that AA is not responsible for any content sent through the Online Services by any third party.

Copyright:

All materials contained in the Online Service are the copyrighted property of AA or its affiliates or third-party licensors. Except for your informational, personal, non-commercial use as authorised, you may not use, modify, reproduce, distribute, transmit, republish or display the content, design or layout of the Online Service, or any components thereof, without the express written permission of AA.

Severability:

If any of these terms should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction which that term is illegal, invalid or unenforceable, it shall be severed and deleted and the remaining Terms of Use shall survive, remain in full force and effect and continue to be binding and enforceable.

Governing Law:

You agree to comply with all laws, rules and regulations applicable to your use of the Online Service.These Terms of Use and your use of the Online Service (and all non-contractual relationships arising out of or connected to it) shall be governed by and construed in accordance with the Malaysian law. You submit to the exclusive jurisdiction of the Malaysian courts to settle any dispute or claim which may arise under, or in respect of, these Terms of Use or your use of the Online Service, except where, by law, such dispute or claim must be brought in the jurisdiction in which you are domiciled, or where the relevant law contains mandatory provisions that override such exclusive jurisdiction. These terms and conditions shall not affect any obligation which we may have under any contract with you to provide you with the Online Service.
